1. Introduction and Acceptance of Terms

Welcome to The Aesthetic Studio. These Terms of Service ("Terms") constitute a legally binding agreement between you ("Client," "you," or "your") and The Aesthetic Studio ("we," "us," "our," or "Clinic") regarding your use of our services, website, and facilities.

By booking an appointment, receiving services, using our website, or engaging with our clinic in any way, you acknowledge that you have read, understood, and agree to be bound by these Terms, as well as our Privacy Policy and Refund Policy.

 

If you do not agree to these Terms, please do not use our services or website.

 

2. Eligibility and Client Requirements

 

2.1 Age Requirements

  • You must be at least 18 years of age to receive services at The Aesthetic Studio

  • Valid government-issued identification may be required to verify age

  • We reserve the right to refuse service to anyone who does not meet age requirements

 

2.2 Client Health and Suitability

 

By booking and receiving services, you represent and warrant that:

  • You are in good general health and have disclosed all relevant medical conditions, medications, allergies, and previous treatments

  • You do not have any contraindications that would make the requested treatment unsafe or inadvisable

  • You have provided complete, accurate, and truthful information on all intake and consent forms

  • You will immediately notify us of any changes to your health status or medications

  • You understand that certain medical conditions, medications, or circumstances may make you ineligible for specific treatments

 

2.3 Pregnancy and Breastfeeding

  • Many aesthetic treatments are contraindicated during pregnancy and breastfeeding

  • You must inform us immediately if you are pregnant, planning to become pregnant, or breastfeeding

  • We reserve the right to postpone or decline treatments during pregnancy or breastfeeding for your safety

 

3. Services Provided

 

3.1 Scope of Services

 

The Aesthetic Studio provides medical aesthetic services including, but not limited to:

  • Injectable treatments (neurotoxins, dermal fillers)

  • Chemical peels

  • Microneedling and microneedling with topical serums

  • Laser hair removal and laser treatments

  • Skincare treatments and facials

  • Hair restoration treatments

  • Retail skincare products

  • Aesthetic consultations

 

3.2 Professional Standards

​

  • All services are performed by licensed and trained medical aesthetic professionals

  • Services are provided in accordance with applicable laws, regulations, and professional standards

  • We adhere to strict health, safety, and sanitation protocols

  • All injectable products used are Health Canada approved and obtained from authorized distributors

 

3.3 Service Modifications

 

We reserve the right to:

  • Modify, discontinue, or update services offered

  • Change pricing with reasonable notice

  • Refuse or discontinue service to any client for any lawful reason

  • Substitute products or techniques when necessary for safety or quality reasons

 

4. Consultation and Informed Consent

 

4.1 Mandatory Consultation

  • All new clients must complete a consultation before receiving services

  • Consultations may be conducted in person or virtually, depending on the service

  • During consultations, we will assess your suitability for treatment, discuss expectations, review risks and benefits, and develop a treatment plan

  • You are encouraged to ask questions and voice any concerns during your consultation

 

4.2 Informed Consent Requirements

 

Before each treatment, you will be required to:

  • Complete a comprehensive medical history and intake form

  • Review and sign treatment-specific consent forms

  • Acknowledge that you understand the procedure, potential risks, benefits, and alternatives

  • Confirm that you have disclosed all relevant medical information

  • Agree to follow pre-treatment and post-treatment instructions

 

4.3 Right to Refuse Treatment

 

We reserve the right to refuse or postpone treatment if:

  • You have not provided complete or accurate medical information

  • You have contraindications that make treatment unsafe

  • You appear to be under the influence of alcohol or drugs

  • You are unable to provide informed consent

  • We determine, in our professional judgment, that treatment is not in your best interest

  • You have not followed pre-treatment instructions

  • Payment has not been secured

 

5. Appointment Policies

 

5.1 Booking Appointments

 

Appointments may be booked:

  • Through our online booking system (Jane App)

  • By phone at (519) 580-8235

  • By email at diggins.em@gmail.com

  • In person at our clinic

 

5.2 Appointment Confirmation

​

  • You will receive appointment confirmation via email or text message

  • It is your responsibility to verify appointment details

  • Please contact us immediately if there are any errors in your confirmation

 

5.3 Cancellation and Rescheduling

 

24-Hour Notice Requirement:

  • You must provide at least 24 hours' notice to cancel or reschedule an appointment

  • Cancellations with less than 24 hours' notice may result in deposit forfeiture or cancellation fees

  • Please refer to our Refund Policy for complete cancellation terms

  • Use the Jane App booking system

 

5.4 Late Arrivals and No-Shows

 

Late Arrivals:

  • Please arrive 10 minutes early for your appointment to complete paperwork

  • Arrivals more than 15 minutes late may require rescheduling

  • Late arrivals may result in shortened treatment times

  • No refunds or credits will be issued for shortened treatments due to late arrival

 

No-Shows:

​

  • Failure to attend a scheduled appointment without notice is considered a no-show

  • No-show appointments may result in:

    • Forfeiture of deposits

    • No-show fees (50% of scheduled service cost)

    • Required prepayment for future bookings

  • Repeated no-shows may result in termination of client relationship

 

5.5 Appointment Changes by The Aesthetic Studio

 

In rare circumstances, we may need to cancel or reschedule your appointment due to:

  • Provider illness or emergency

  • Equipment malfunction

  • Facility issues

  • Unforeseen circumstances

 

If we must cancel your appointment:

  • We will provide as much notice as possible

  • We will work with you to reschedule at your earliest convenience

  • Any deposits will be fully refunded or credited to your rescheduled appointment

 

6. Payment Terms

 

6.1 Payment Methods

 

We accept the following payment methods:

  • Credit cards (Visa, Mastercard, American Express)

  • Debit cards

  • Cash

  • Gift cards and credit packages

 

6.2 Pricing and Fees

  • All prices are in Canadian Dollars (CAD)

  • Prices are subject to change without notice

  • Current pricing is available on our website, booking system, or by contacting us

  • Applicable taxes (HST) will be added to all services and products

  • Deposits may be required for certain services or first-time clients

 

6.3 Payment Due Dates

  • Payment is due at the time of service unless other arrangements have been made

  • Package and series treatments must be paid in full at time of purchase unless a payment plan has been arranged

  • Outstanding balances must be paid before scheduling future appointments

 

6.4 Payment Plans and Financing

​

  • Payment plans may be available for certain services and packages

  • Third-party financing options may be available (subject to credit approval)

  • Payment plan terms will be outlined in a separate agreement

  • Failure to make scheduled payments may result in suspension of services and collection proceedings

 

6.5 Returned Payments

​

  • A fee of $25 will be charged for returned checks or declined payment methods

  • Services will be suspended until payment is resolved

  • Repeated payment issues may result in cash-only requirements

 

7. Treatment Expectations and Results

 

7.1 No Guarantee of Results

​

Important: Individual results vary, and we cannot guarantee specific outcomes.

​

  • Aesthetic treatments produce different results for different individuals

  • Results depend on factors including age, skin type, lifestyle, genetics, and adherence to pre- and post-treatment care

  • Before and after photos are examples only and do not represent guaranteed results

  • Some treatments require multiple sessions to achieve desired results

  • Results are temporary and maintenance treatments may be required

 

7.2 Realistic Expectations

  • We will provide honest, realistic expectations during your consultation

  • We will not promise results that are unrealistic or unattainable

  • You are responsible for communicating your goals clearly during consultation

  • If your expectations cannot be safely or realistically achieved, we will discuss alternatives

 

7.3 Treatment Variables

 

Results may be affected by:

  • Following (or not following) pre-treatment instructions

  • Following (or not following) post-treatment care instructions

  • Concurrent use of certain medications or supplements

  • Smoking, alcohol consumption, and sun exposure

  • Stress, sleep, hydration, and nutrition

  • Underlying medical conditions

  • Individual healing and metabolic factors

 

8. Risks and Complications

 

8.1 Acknowledgment of Risks

 

All medical aesthetic treatments carry inherent risks, including but not limited to:

 

Common Side Effects:

  • Redness, swelling, bruising

  • Tenderness or discomfort at treatment site

  • Temporary numbness or altered sensation

  • Minor bleeding or pinpoint marks

  • Temporary pigmentation changes

 

Rare but Serious Risks:

​

  • Allergic reactions

  • Infection

  • Scarring

  • Vascular complications

  • Nerve damage

  • Asymmetry or undesired cosmetic outcomes

  • Need for additional corrective treatments

 

8.2 Client Responsibilities for Risk Mitigation

 

You agree to:

​

  • Disclose all relevant medical information, medications, and allergies

  • Follow all pre-treatment and post-treatment instructions

  • Attend all recommended follow-up appointments

  • Report any concerning symptoms or complications immediately

  • Refrain from treatments if you have active infections, cold sores, or other contraindications

 

8.3 Emergency Situations

 

In the event of a serious adverse reaction or complication:

  • If experiencing a medical emergency, call 911 or go to the nearest emergency room

  • Seek immediate medical attention for symptoms such as severe pain, vision changes, difficulty breathing, or signs of infection

 

9. Pre-Treatment and Post-Treatment Care

 

9.1 Pre-Treatment Instructions

You are responsible for:

​

  • Following all pre-treatment instructions provided by your practitioner

  • Disclosing all medications, supplements, and recent treatments

  • Avoiding blood-thinning medications and supplements (when advised)

  • Arriving with clean skin (no makeup for facial treatments)

  • Staying hydrated and well-rested

9.2 Post-Treatment Instructions

​

You agree to:

​

  • Follow all post-treatment care instructions carefully

  • Avoid sun exposure and use sun protection as directed

  • Refrain from strenuous exercise, saunas, or hot tubs as instructed

  • Avoid alcohol and blood-thinning substances as directed

  • Not touch, pick, or scratch treated areas

  • Attend all recommended follow-up appointments

 

9.3 Consequences of Non-Compliance

  • Failure to follow pre- or post-treatment instructions may compromise results

  • Complications arising from non-compliance are not grounds for refunds or complimentary corrective treatments

  • We are not liable for poor outcomes resulting from failure to follow care instructions

 

10. Photography and Image Use

 

10.1 Clinical Photography

​

  • Before and after photos may be taken for your medical records

  • These photos are stored securely and treated as confidential health information

  • Clinical photos for your records will not be used for marketing without separate consent

 

10.2 Marketing and Promotional Use

 

Separate Consent Required:

​

  • We will never use your photos for marketing purposes without your explicit written consent

  • You may be asked to sign a separate photo release form

  • You may withdraw consent for future use of your images at any time

  • Consenting to photo use may entitle you to discounts or special offers

 

If You Consent:

  • Your photos may be used on our website, social media, marketing materials, and promotional content

  • We will not include your full name or identifying information unless you specifically consent

  • Photos may be edited for quality, lighting, or cropping

  • We retain the right to use consented photos indefinitely unless you withdraw consent

  • Your information is treated as confidential and protected with appropriate security measures

11.2 Client Obligations

 

You agree to:

  • Respect the privacy of other clients

  • Not photograph or record other clients or staff without permission

  • Keep all information about other clients confidential

  • Maintain respectful behavior in our clinic environment

 

12. Prohibited Conduct

 

12.1 Client Conduct Expectations

 

You agree NOT to:

​

  • Provide false or misleading information on intake forms

  • Arrive under the influence of alcohol or drugs

  • Engage in harassing, threatening, or abusive behavior toward staff or other clients

  • Record or photograph inside the clinic without permission

  • Disrupt clinic operations or other clients' experiences

  • Use our services for fraudulent purposes

  • Request services for illegal or unethical purposes

 

12.2 Consequences of Prohibited Conduct

 

Violation of these conduct expectations may result in:

​

  • Immediate termination of your appointment without refund

  • Termination of the client relationship

  • Forfeiture of packages, memberships, or prepaid services

  • Reporting to appropriate authorities if illegal activity is suspected

  • Legal action if necessary

 

13. Liability and Indemnification

 

13.1 Limitation of Liability

 

To the fullest extent permitted by law:

  • The Aesthetic Studio's total liability for any claim shall not exceed the amount you paid for the specific service in question

  • We are not liable for indirect, incidental, consequential, or punitive damages

  • We are not liable for complications or poor results arising from:

    • Your failure to disclose medical information

    • Your failure to follow pre- or post-treatment instructions

    • Your use of unauthorized products or treatments from other providers

    • Normal variations in treatment outcomes

    • Complications that are inherent risks of the procedure

 

13.2 Client Indemnification

 

You agree to indemnify and hold harmless The Aesthetic Studio, its owners, employees, and contractors from any claims, damages, or expenses (including legal fees) arising from:

  • Your violation of these Terms of Service

  • Your provision of false or misleading information

  • Your failure to follow instructions or advice

  • Your negligent or intentional misconduct

  • Any third-party claims arising from your use of our services

 

13.3 Insurance

 

The Aesthetic Studio maintains appropriate professional liability insurance. However, you are encouraged to maintain your own health insurance coverage.

 

14. Products and Retail Sales

 

14.1 Product Recommendations

  • Products recommended by our practitioners are based on professional assessment of your needs

  • We are not liable for allergic reactions or adverse events from products unless caused by our negligence

  • Always perform a patch test with new products as instructed

  • Discontinue use and contact us if you experience adverse reactions

 

14.2 Product Returns

  • Refer to our Refund Policy for complete product return terms

  • Generally, unopened products may be returned within 14 days

  • Opened products cannot be returned for health and safety reasons

 

14.3 External Product Use

  • Using products or treatments from other providers may interfere with our treatment outcomes

  • Always disclose all skincare products, treatments, and procedures you are using or have recently received

  • We are not responsible for complications arising from undisclosed external treatments or products

 

15. Gift Cards and Packages

 

15.1 Gift Card Terms

  • Gift cards do not expire

  • Gift cards are non-refundable and cannot be redeemed for cash (except where required by law)

  • Lost or stolen gift cards cannot be replaced unless we have a record of purchase

  • Gift cards are transferable to other individuals

 

15.2 Treatment Packages

​

  • Treatment packages are non-refundable

  • Packages must be used within the specified time period (typically 6-12 months)

  • Expired packages cannot be extended or refunded

  • Packages are non-transferable unless we provide written approval

  • Unused treatments in packages cannot be refunded for cash

16.1 Booking Platform (Jane App)

  • We use Jane App as our booking and practice management system

  • Your use of Jane App is subject to Jane App's own terms of service and privacy policy

  • We are not responsible for technical issues, outages, or problems with third-party platforms

  • Payment processing is handled by secure third-party payment processors

  • Your payment information is subject to the payment processor's terms and privacy policy

  • We do not store complete credit card information on our systems

 

16.3 External Links

17. Intellectual Property

18. Dispute Resolution

18.3 Jurisdiction

 

You agree that any legal action or proceeding arising from these Terms or your use of our services shall be brought exclusively in the courts of Ontario, Canada, and you consent to the jurisdiction of such courts.

 

18.4 Mediation and Arbitration

 

If informal resolution fails, both parties agree to attempt mediation before pursuing litigation. If mediation is unsuccessful, disputes may be resolved through binding arbitration in accordance with Ontario law.

 

19. Termination of Services

 

19.1 Termination by Client

 

You may terminate your relationship with The Aesthetic Studio at any time by:

  • Providing written notice

  • Subject to the terms of any packages, payment plans, or contracts in effect

 

19.2 Termination by The Aesthetic Studio

 

We reserve the right to terminate our relationship with any client if:

  • You violate these Terms of Service

  • You engage in prohibited conduct

  • You fail to pay for services

  • You provide false information

  • You exhibit threatening, abusive, or harassing behavior

  • The client relationship is no longer appropriate or safe

  • We determine, in our sole discretion, that termination is necessary

 

19.3 Effect of Termination

Upon termination:

​

  • Any outstanding balances become immediately due

  • Prepaid packages and services may be forfeited (subject to our Refund Policy)

  • You must return any clinic property

  • You will no longer have access to our services or facilities

 

20. Miscellaneous Provisions

 

20.1 Entire Agreement

 

These Terms, together with our Privacy Policy and Refund Policy, constitute the entire agreement between you and The Aesthetic Studio regarding your use of our services.

 

20.2 Severability

 

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will remain in full force and effect.

 

20.3 Waiver

 

Our failure to enforce any provision of these Terms does not constitute a waiver of that provision or any other provision.

 

20.4 Assignment

 

You may not assign or transfer your rights or obligations under these Terms without our written consent. We may assign our rights and obligations without restriction.

 

20.5 Force Majeure

 

We are not liable for delays or failures in performance resulting from circumstances beyond our reasonable control, including acts of God, natural disasters, pandemics, government actions, labor disputes, or other force majeure events.

20.6 Survival

 

Provisions that by their nature should survive termination (including payment obligations, liability limitations, indemnification, and dispute resolution) will survive termination of these Terms.

 

21. Amendments to Terms

 

21.1 Right to Modify

 

We reserve the right to modify these Terms at any time. Changes will be effective upon:

  • Posting the updated Terms on our website with a new "Last Updated" date

  • Providing notice through our booking system, email, or in-clinic signage

 

21.2 Continued Use

 

Your continued use of our services after changes are posted constitutes acceptance of the updated Terms. If you do not agree to the modified Terms, you must discontinue use of our services.

  • You understand that results cannot be guaranteed

  • You agree to the cancellation, payment, and refund policies outlined herein
